TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By downloading, accessing, or using the Nodus application ("App"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, you must immediately uninstall and cease use of the App.

2. NATURE OF THE SERVICE

Nodus is a decentralized, peer-to-peer (P2P) utility that synchronizes video playback states and facilitates direct video file transfers between users using WebRTC and BitTorrent protocols. Nodus acts solely as a technological conduit. We do not host, store, index, or provide any video content, media files, or movies.

3. ACCEPTABLE USE & USER CONDUCT

You are solely responsible for the video files ("Video Content") you transmit, share, or sync through Nodus. You explicitly agree NOT to use Nodus to:

• Share, transfer, or sync any video file that is copyrighted, trademarked, or otherwise protected by intellectual property laws without the express permission of the rights holder.
• Distribute malware, viruses, or any malicious software packages.
• Transmit illegal, abusive, harassing, or exploitative video media.

We reserve the right to terminate your access to our signaling servers (Firebase) if we detect abuse or exploitation of our network infrastructure.

4. TORRENT PROTOCOL & IP VISIBILITY

Nodus utilizes standard torrenting protocols for large-group video playback synchronization. By participating in a group watch room session exceeding two peers, you acknowledge and agree that your Internet Protocol (IP) address will be visible to other peers connected to the same session swarm. You accept all risks associated with peer-to-peer network visibility.

5. INTELLECTUAL PROPERTY & DMCA SAFE HARBOR

Because Nodus does not host or store video files on our servers, we cannot remove content from the P2P network. However, we strictly prohibit the use of our signaling infrastructure for piracy. If you believe your copyrighted work is being exploited via our signaling servers, you may contact our developer support channel.

6. DISCLAIMER OF WARRANTIES

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees regarding the speed, security, or reliability of peer-to-peer video transfers or synchronization. We are not responsible for any video data loss, network charges, or device damage resulting from your use of the App.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the developer of Nodus shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to legal actions taken against you for sharing copyrighted video material. You assume total responsibility for the video files you choose to transfer.
